The Department of Energy's Office of Nuclear Energy is setting up a nuclear fuel Defense Production Act Consortium that will seek voluntary agreements with interested companies "to increase fuel availability, provide more access to reliable power, and end America's reliance on foreign sources of enriched uranium and critical materials needed to power the nation's nuclear renaissance." Why the DPA?

The DPA dates to 1950, when it was enacted as a tool to compel private companies to produce materials needed for national defense, and has since been amended several times to support the government's response to natural disasters and other emergencies. Section 708 allows for "voluntary agreements" with U.S. companies, and it was used in 2020 as part of the government's response to the COVID-19 pandemic.

Now, because "the United States currently lacks the sufficient domestic nuclear fuel resources to meet projected demand and requires swift and decisive action to secure the nation's economic and national security interests," DOE-NE is building a DPA Consortium.

Industry participants taking part in a voluntary agreement or plan of action under the DPA "are provided with immunity for any civil or criminal action brought under the antitrust laws of the United States or any similar state law," but that immunity is limited to "actions taken to develop or carry out a voluntary agreement or plan of action" and "does not apply to any act or omission occurring after the termination of the voluntary agreement or plan of action."

Next steps

Membership is free and open to any U.S. company involved in the nuclear fuel cycle as well as end-users, "regardless of the location of the ultimate business owner," but membership requires DOE-NE approval.

Voluntary agreements could "allow consultation with domestic nuclear energy companies to discuss and implement methods to enhance the capability to manage spent nuclear fuel, including the recycling and reprocessing of spent nuclear fuel," and allow industry consultation to establish "plans of action to ensure that the nuclear fuel supply chain capacity, including milling, conversion, enrichment, deconversion, fabrication, recycling, or reprocessing, is available to enable the continued reliable operation of the Nation's existing, and future, nuclear reactors." The energy secretary is also authorized "to provide procurement support, forward contracts, or guarantees to such consortia as a means to ensure offtake for newly established domestic fuel supply, including conversion, enrichment, reprocessing, or fabrication capacity."

Before a voluntary agreement or plan of action developed through the consortium becomes effective, the energy secretary must certify that it is necessary, and the U.S. attorney general must find in writing that "such purpose may not reasonably be achieved through a voluntary agreement or plan of action having less anticompetitive effects or without any voluntary agreement or plan of action."

Nuclear fuel supply chain—the last four years

According to the DOE, the DPA Consortium "will operate separately from currently appropriated low-enriched uranium and [HALEU] procurement and allocation programs but may inform future programmatic efforts."

Open to public inspection

DOE's interim final rule on the DPA Consortium was published in the August 25 _Federal Register._ During the 30-day period required before a federal action under DPA Sec. 708 can take effect, the DOE is seeking public comment. The interim rule will be effective and public comments will be due on September 24.

Industry experts differ in explaining why the permitting process can be so painstaking.

Lisa Epifani, head of policy at conservative clean energy organization ClearPath, said in a panel that legislation around permitting needs to be streamlined, because the National Environmental Policy Act duplicates provisions of the Clean Air Act and Clean Water Act.

However, Charles Bolden, senior director of congressional affairs for the Solar Energy Industries Association, said that while NEPA continues to be "one of the most controversial components" of the energy industry, understaffed agencies are also a cause of delays.

Multiple experts also pointed out that the slow permitting process applies to transmission lines as well, despite new transmission lines being essential for meeting energy demand.

"We've got 1,250 gigawatts of installed electricity but only 35 gigawatts of transfer capacity," said Will Rogers, principal at Converge Strategies, a consulting firm that specializes in energy resilience and national security. "That's just not tenable for the situation that we're looking at."

Other obstacles for new energy projects included uncertainty around Inflation Reduction Act funding, several speakers noted. In addition to freezing funding related to the law earlier in the year, the recently passed Republican budget bill also included new phase-out timelines and restrictions for some renewable energy tax credits. More recently, there are indications that a $7 billion solar program included in the IRA could be on the chopping block. Additionally, speakers said that some companies are struggling to obtain key parts, especially in the face of steep trade tariffs.

In the last year, 45 new facilities have opened for manufacturing renewable energy-related components, and another 188 are under construction or planned for development, according to John Hensley, senior vice president of markets and policy analysis at the American Clean Power Association. But with uncertainty around tariffs, "there's sort of a question of how much do the manufacturers want to invest in that space and be left holding a ton of capacity," he said.

Proposal submitted for SMR power plant in Lund

Project companies established

Norsk Kjernekraft has formally launched a new wholly-owned subsidiary, Øygarden Kjernekraft AS, with the purpose of investigating, building and operating SMRs in Øygarden municipality, just outside Bergen. The new company will further investigate the construction and operation of a plant consisting of several SMRs in Øygarden at the Kollsnes industrial area.

On 8 August last year, Norsk Kjernekraft submitted a proposal to the Ministry of Energy for an assessment of the construction of a power plant based on up to five SMRs of 300 MWe each in Øygarden. The proposed location is an area of up to 250 acres (101 hectares) at Buneset, which is owned by landowner and former mayor of Øygarden, Rolv Svein Rougnø.

"The establishment of Øygarden Kjernekraft AS marks a new and concrete phase in our commitment to SMR technology in Norway," said Norsk Kjernekraft CEO Jonny Hesthammer. "Øygarden is an area with large energy needs and great development potential, not least through industrial projects at Kollsnes. With this subsidiary, we will have a clear structure for conducting project development, application work and later construction and operation."

Meanwhile, Narvik Municipality, through its business development company Futurum, has established Narvik Kjernekraft AS, together with Norsk Kjernekraft. The company will investigate, and possibly plan, build and operate nuclear power plants based on SMRs in Narvik.

Narvik Kjernekraft will now begin planning a formal assessment phase: preparing a proposal for an assessment programme.

"We are very proud of the partnership with Narvik Municipality and Futurum AS," Hesthammer said. "Narvik Kjernekraft AS marks the start of a new phase where nuclear power can contribute to local value creation and security of supply."
